("Music Reports," "we," "us," and "our"). This Privacy Policy describes the kinds of information we collect when you visit the Site and the Related Services, how we collect and use this information, and how we protect its security. This policy is also intended to inform you about your rights regarding your Personal Information, and to provide you with information necessary for you to exercise those rights. Capitalized terms have the meanings assigned to them in this Privacy Policy or in our Terms and Conditions of Use. By using the Site, you consent to our collection, processing, and retention of your Personal Information and Usage Information pursuant to this policy. This Privacy Policy has been updated, and is effective as of the date first written above. We may revise the policy from time to time, and will post a new effective date in that event. We will provide notice to you if these changes would result in uses of Personal Information that are materially inconsistent with the notice we provided when we collected the information from you. Such notice may be delivered by email to you at the last email address you provided us (if you are a Music Reports account holder), by posting notice of such changes on the Site, and/or by other means consistent with applicable law. Your continued use of the Site or the Related Services will indicate your consent to the Privacy Policy then posted.
2. About Us
In certain contexts, Music Reports may be the controller of Personal Information and Usage Information that you submit or that we collect as you use this Site and the Related Services, and therefore responsible for how the information is used within the scope of this Privacy Policy. In some jurisdictions, including California, we may be considered a business that controls the collection of a consumer's personal information. In some cases, we may also be: a processor, of your personal information--for example, when we organize the information, store it, or use it to provide you with services or data you have requested, and/or a "contractor" or "service provider" to which other businesses have made Personal Information available for a business purpose pursuant to a written contract that contains certain restrictions; and/or a "service provider" that processes Personal Information on behalf of a business. 3. Information We Collect
a. Personal Information -- Your "Personal Information" is information that identifies you or your household, either directly or indirectly. It may include your name, mailing address, telephone number, email address, I.P. address, an account name you use in connection with one or more Related Services, as well as other information you provide that could be used to identify you. In order to access certain information and features contained on the Site, we may require you to register for a particular type of account or provide additional types of information--for example, to tell us whether you are a music owner or a music user. When we combine Personal Information with other information, we will treat the combined information as Personal Information, as well. When you provide Personal Information, you are also consenting to our collecting and processing it for the purposes disclosed on the portion of the site where you enter the information. If you do not consent to such collection and processing, do not enter the information.
In the past 12 months we have collected the following categories of Personal Information about Site users:
Identifiers where we are permitted or required by law to collect them; these may include, without limitation, your name, an alias you use, your address, your phone number, your email address, or the IP address of a computer you use to access the Site;
Professional information; and
Usage Information (as described below)
b. Usage Information -- "Usage Information" is information that describes how you access and use the Site. Usage Information may tell us how many times you visit the site or log in to your account. Your Usage Information may also include the IP address of the device you've used to contact the Site, when we are permitted by law to collect this information; however, Music Reports is not generally able to associate or link such an address with any individual consumer's identity. In many cases, Usage Information is anonymized, or rendered anonymous when it is combined with other people's Usage Information --for example, so we may track how many people are using the Site. Although Usage Information doesn't necessarily identify you, when it does so, or when we combine this information with information that does identify you, we treat it as Personal Information.
4. How and From Whom We Collect Your Information
We collect Personal Information you provide while visiting the Site, such as when you click "Sign Up," fill in forms such as those headed "Tell Us Some More . . ." and "Create Account," or click a link to request information from Music Reports. We collect Usage Information through a number of automated technologies while you're interacting with the site. Some of these technologies may not be evident, and they may be in use even if you have not registered an account. They include cookies, and application program interfaces ("APIs"). Music Reports provides a "cookie banner" that enables you to deny the ability to use cookies, other than those required to enable basic functionality of the Site. You should be aware that some features of the Site may not function properly if you refuse cookies.
In the past 12 months we have collected Personal Information about consumers from the following categories of sources:
Consumers themselves;
Third parties, including music publishing administrators, as well as performance rights organizations, where such information was publicly available;
Observing Site users' behavior as described above.
California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Music Reports does not respond to DNT signals at this time. In addition, as Music Reports does not sell Personal Information, we do not currently honor Global Privacy Control (GPC) as a method for submitting opt-out requests.
5. How and Why We Use Your Information
How we use your information depends on which parts of our Site and of the Related Services you visit, whether you become a Registered User, and whether you elect to receive specific services or information. We may use your Personal and Usage Information for the following reasons:
To allow you to complete the account registration process, if you elect to register an account;
To authorize your access to portions of the Site that provide services you have selected;
To help you locate information in our databases;
To provide customer service, respond to inquiries and complaints, and to resolve service issues;
To facilitate the licensing of your music by potential licensees;
To facilitate the delivery of royalty statements and royalty payments to you, your publishing administrator, or your designated payee;
To simplify your experience on the Site;
To make it easier and faster for you to log in or navigate the Site on future visits;
To monitor the operation of the Site to make sure it works efficiently and smoothly;
To analyze how the Site is used so we know which parts are especially popular or heavily visited; and
To recommend new or different services to you.
If you are a Registered User, we may use your Personal Information for specific purposes described during the registration process or when you "opt in" to certain services or offers on the Site or in the Related Services--for example, to claim your ownership, co-ownership, or control of music. We may also process your Personal Information, on our clients' behalf, so we may issue royalty statements and payments our clients are legally obligated to issue to you, your publishing administrator, or your designated payee under their licenses with you.
We do not sell or share Personal Information (including the Personal Information of consumers under 16 years of age) within the definition of the California Consumer Privacy Act (the "CCPA"), and have not sold or shared Personal Information in the past 12 months. Moreover, Music Reports does not collect, and also does not use or disclose, Sensitive Personal Information (as defined in the CCPA) for purposes other than those specified in Section 7027(m) of the California Code of Regulations.
This Site and the Related Services may include links to websites controlled by third parties. The privacy policies of these third-party sites may differ significantly from this Privacy Policy. We are not responsible for the privacy practices of third parties or their websites and make no warranties or representations about the security of any Personal Information they collect.
6. Your Privacy Rights and Choices
California Residents
If you are a "consumer" under California law (that is, a resident of California) you have certain specific rights in connection with your Personal Information. These rights vary in other jurisdictions but may include some or all of the California rights listed here:
1. The right to know what Personal Information we have collected about you, including the categories of such information, the categories of sources from which it is collected, the business or commercial purpose for collecting it, the categories of third parties to whom we disclose such information, and the specific pieces of Personal Information we have collected about you.
2. The right to delete Personal Information that we have collected from you, subject to certain exceptions.
3. The right to correct inaccurate Personal Information that we maintain about you.
4. The right not to receive discriminatory treatment by Music Reports for the exercise of your CCPA privacy rights.
5. The right to limit our use and disclosure of "Sensitive Personal Information," which includes your social security number, except as necessary to perform services reasonably expected by an average consumer who requests such services or as otherwise permitted by law.
6. The right to opt out of the sale or sharing of your Personal Information, as defined by law. NOTE: Music Reports does not sell or share Personal Information within the meaning of California law.
How to Exercise Your Privacy Rights
Depending on your place of residence, you may request to exercise some or all of the privacy rights listed above in relation to your Personal Information You may do so by using our Privacy Request Form, or by contacting Music Reports at the address or phone number provided in Section 2 of this Privacy Policy.
In general, the more information you are able to provide us for verification purposes, the more likely we will be able to verify your identity; however, for this purpose you should not provide Sensitive Personal Information, such as your taxpayer ID number.
If you use an authorized agent to submit a request to know, correct, or delete Personal Information, we will require the authorized agent to provide proof that you gave the agent signed permission to submit the request, and will also require you to verify your own identity (as described in this section) and to confirm with us directly that you provided the authorized agent permission to submit the request, unless you have provided the authorized agent with power of attorney for this purpose.
Please be aware that if you exercise the right to delete information, we may not be able to provide services that you have requested, that you expect, or that may benefit you. For example, we may be unable to issue royalty statements or payments on our clients' behalf, and as a result they may stop making your already-licensed music available to listeners. If the collection of your Personal Information is required by law or applicable professional standards (such as those of our financial auditors) in order for us to demonstrate compliance with the law, document consent, or provide certain services (e.g., in order to provide licensing or royalty payment services on behalf of one or more of our clients), when possible we will make this clear at the point of collection so you can make informed decisions.
7. Children
The Site and the Related Services are intended solely for business-to-business use. In keeping with the Terms and Conditions of Use, all users of this Site agree that they are at least 18 years old, or, if between the age of 13 and 17, inclusive, have obtained the consent of a person or guardian. We do not sell personal information, including information from anyone under the age of 16. If you are a California resident under the age of 18 and have registered with this Site or any of the Related Services, you may request and obtain removal of content or Personal Information you have submitted to us by writing to us at the address in Section 2 above. However, California law requires us to notify you that such a request does not ensure the complete removal of your Personal Information.
8. Security
Protecting the security of your personal information is very important to us. Your online account information is protected by a password you establish. We make available an online facility to change your password and we recommend you do so. Access to that online account requires your username and password. We recommend that you do not disclose your username and password to any other person. We have implemented technical, administrative, and physical security measures designed to protect your information from unauthorized access, disclosure, use, and modification. We regularly review our security procedures to consider appropriate new technology and methods. Whenever your information is transmitted from our servers, it is also protected by industry standard SSL (secure socket layer) encryption. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personal information. California residents: In the unlikely event our data security is breached, we will, without unreasonable delay, disclose the breach to residents of California whose personal information was, or is reasonably believed to have been, acquired by an unauthorized person, subject to the needs of law enforcement.
